{"id":38420,"date":"2019-04-02T05:23:19","date_gmt":"2019-04-02T05:23:19","guid":{"rendered":"https:\/\/qatar-news.org\/qatarnewsEn\/?p=38420"},"modified":"2019-04-02T05:23:19","modified_gmt":"2019-04-02T05:23:19","slug":"un-slams-inhuman-brunei-stoning-laws","status":"publish","type":"post","link":"https:\/\/qatar-news.org\/qatarnewsEn\/?p=38420","title":{"rendered":"UN slams &#8216;inhuman&#8217; Brunei stoning laws"},"content":{"rendered":"<div id=\"body-200771816342556199\" readability=\"156.149709615\">\n<p class=\"speakable\">The <a href=\"https:\/\/www.aljazeera.com\/topics\/organisations\/un.html\">United Nations<\/a> has criticised new &#8220;cruel and inhuman&#8221; laws set to take effect in <a href=\"https:\/\/www.aljazeera.com\/topics\/country\/brunei.html\">Brunei<\/a> this week, which impose death by stoning for adultery and gay sex, and amputations for theft.<\/p>\n<p class=\"speakable\">The controversial measures &#8211; part of a new penal code set to be implemented on Wednesday &#8211; have drawn widespread condemnation.<\/p>\n<p class=\"speakable\">UN human rights chief <a href=\"https:\/\/www.aljazeera.com\/topics\/people\/michelle-bachelet.html\">Michelle Bachelet<\/a> in a\u00a0<a href=\"https:\/\/www.ohchr.org\/EN\/NewsEvents\/Pages\/DisplayNews.aspx?NewsID=24432&#038;LangID=E\" target=\"_blank\">statement<\/a>\u00a0on Monday urged Brunei&#8217;s government to halt the entry into force of the &#8220;draconian&#8221; new penal code, saying it would &#8220;mark a serious setback for <a href=\"https:\/\/www.aljazeera.com\/topics\/categories\/human_rights.html\">human rights<\/a>\u00a0protections for the people of Brunei if implemented&#8221;.\u00a0<\/p>\n<p>An absolute monarchy, ruled for 51 years by Sultan Hassanal Bolkiah, Brunei first announced the new penal code in 2013, but <a href=\"https:\/\/www.aljazeera.com\/news\/asia-pacific\/2014\/04\/brunei-adopts-phase-one-islamic-law-201443051454609650.html\">full implementation<\/a> has been delayed in the face of opposition by rights groups and as officials worked out the practical details.\u00a0<\/p>\n<p><span>Bolkiah, 72, is the world&#8217;s second-longest reigning monarch and ranks as one of the world&#8217;s wealthiest people.<\/span><\/p>\n<p>The new law mostly applies to Muslims, though some aspects will also apply to non-Muslims. Brunei retains death penalty in law but has been abolitionist in practice since 1957. <\/p>\n<p>Learn more: <a href=\"https:\/\/t.co\/BgWjo1o5Fb\">https:\/\/t.co\/BgWjo1o5Fb<\/a> <a href=\"https:\/\/t.co\/Jx8J5bTPzK\">pic.twitter.com\/Jx8J5bTPzK<\/a><\/p>\n<p>\u2014 UN Human Rights (@UNHumanRights) <a href=\"https:\/\/twitter.com\/UNHumanRights\/status\/1112682862992605189?ref_src=twsrc%5Etfw\">April 1, 2019<\/a><span>\u00a0<\/span>\n<\/p><\/blockquote>\n<p>It also introduces public flogging as punishment for <a href=\"https:\/\/www.aljazeera.com\/topics\/subjects\/abortion.html\">abortion<\/a> as well as amputation for theft and criminalises exposing Muslim children to the beliefs and practices of any religion other than <a href=\"https:\/\/www.aljazeera.com\/topics\/subjects\/islam.html\">Islam<\/a>.<\/p>\n<h2>&#8216;High risk of miscarriages of justice&#8217;<\/h2>\n<p>Homosexuality has long been illegal in the oil-rich sultanate, which practises a stricter brand of Islam than neighbours <a href=\"https:\/\/www.aljazeera.com\/topics\/country\/malaysia.html\">Malaysia<\/a> and <a href=\"https:\/\/www.aljazeera.com\/topics\/country\/indonesia.html\">Indonesia<\/a>, but it will now become a capital offence.\u00a0<\/p>\n<p>Currently, only <a href=\"https:\/\/www.aljazeera.com\/topics\/country\/saudi-arabia.html\">Saudi Arabia<\/a>, Iran, Mauritania and <a href=\"https:\/\/www.aljazeera.com\/topics\/country\/sudan.html\">Sudan<\/a>\u00a0have laws in place that punish homosexuality with death, though it appears such death penalties have not been carried out in recent years, according to UN rights spokeswoman Ravina Shamdasani.\u00a0<\/p>\n<p>In Monday&#8217;s statement, Bachelet urged Brunei to uphold a long tradition of not applying death penalty laws that have remained on its books. I urge Brunei to maintain its de facto moratorium on the use of capital punishment,&#8221; Bachelet said.\u00a0<\/span><\/p>\n<p>The UN rights chief also warned that the new laws could encourage violence and discrimination on the basis of gender, sexual orientation and religious affiliation.\u00a0<\/p>\n<p>&#8220;Any religion-based legislation must not violate human rights, including the rights of those belonging to the majority religion as well as of religious minorities and non-believers,&#8221; she said.\u00a0<\/p>\n<h2>International condemnation<\/h2>\n<p>Bachelet&#8217;s comments come after a long line of politicians, <a href=\"https:\/\/www.amnesty.org\/en\/latest\/news\/2019\/03\/brunei-darussalam-heinous-punishments-to-become-law-next-week\/\" target=\"_blank\">rights groups<\/a> and celebrities, including actor George Clooney and musician Elton John, condemned the new laws.\u00a0<\/p>\n<p>Clooney and John are among those calling for a boycott of hotels owned by the sultanate, which <a href=\"https:\/\/twitter.com\/eltonofficial\/status\/1112070073521455105\" target=\"_blank\">include<\/a> the Beverly Hills Hotel, the Dorchester in London and the Plaza Athenee in Paris.<\/p>\n<blockquote class=\"twitter-tweet\" data-lang=\"en\" readability=\"8.10631229236\">\n<p dir=\"ltr\" lang=\"en\">I commend my friend, <a href=\"https:\/\/twitter.com\/hashtag\/GeorgeClooney?src=hash&#038;ref_src=twsrc%5Etfw\">#GeorgeClooney<\/a>, for taking a stand against the anti-gay discrimination and bigotry taking place in the nation of <a href=\"https:\/\/twitter.com\/hashtag\/Brunei?src=hash&#038;ref_src=twsrc%5Etfw\">#Brunei<\/a> &#8211; a place where gay people are brutalized, or worse &#8211; by boycotting the Sultan\u2019s hotels.<a href=\"https:\/\/t.co\/8ymurW7hqm\">https:\/\/t.co\/8ymurW7hqm<\/a><\/p>\n<p>\u2014 Elton John (@eltonofficial) <a href=\"https:\/\/twitter.com\/eltonofficial\/status\/1112070070103146496?ref_src=twsrc%5Etfw\">Marc 30, 2019<\/a>\n<\/p><\/blockquote>\n<p>Last week, former US Vice President Joe Biden called the new penal code &#8220;appalling and immoral&#8221; and said there was no excuse for such &#8220;hate and inhumanity&#8221;.\u00a0<\/p>\n<p>The United Kingdom, <a href=\"https:\/\/www.aljazeera.com\/topics\/country\/australia.html\">Australia<\/a> and New Zealand have all called on Brunei to abandon the changes to its penal code.
