{"id":24971,"date":"2018-12-10T10:23:51","date_gmt":"2018-12-10T10:23:51","guid":{"rendered":"https:\/\/qatar-news.org\/qatarnewsEn\/?p=24971"},"modified":"2018-12-10T10:23:51","modified_gmt":"2018-12-10T10:23:51","slug":"european-court-of-justice-rules-uk-can-unilaterally-cancel-brexit","status":"publish","type":"post","link":"https:\/\/qatar-news.org\/qatarnewsEn\/?p=24971","title":{"rendered":"European Court of Justice rules UK can unilaterally cancel Brexit"},"content":{"rendered":"<div id=\"body-200771816342556199\" readability=\"147.267996531\">\n<p class=\"speakable\">The <a href=\"https:\/\/www.aljazeera.com\/topics\/organisations\/european-union.html\">European Union<\/a>&#8216;s top court has ruled that Britain may unilaterally reverse its decision to leave the bloc.\u00a0<\/p>\n<p class=\"speakable\">In a judgment <a href=\"https:\/\/twitter.com\/EUCourtPress\/status\/1072039706123210752\" target=\"_blank\">delivered<\/a> on Monday, the European Court of Justice said the <a href=\"https:\/\/www.aljazeera.com\/topics\/country\/united-kingdom.html\">United Kingdom<\/a> could revoke Article 50 &#8211; the exit clause in the EU&#8217;s constitution &#8211; &#8220;in accordance with its own national constitutional requirements&#8221;.<\/p>\n<p class=\"speakable\">&#8220;That possibility exists for as long as a withdrawal agreement concluded between the EU and that Member State has not entered into force or, if no such agreement has been concluded, for as long as the two-year period from the date of the notification of the intention to withdraw from the EU, and any possible extension, has not expired,&#8221; it added.<\/p>\n<p><span>&#8220;Such a revocation \u2026 would have the effect that the United Kingdom remains in the EU under terms that are unchanged as regards its status as a Member State.&#8221;<\/span><\/p>\n<p><span>The UK is due to leave the EU on March 29 next year, two years after it triggered Article 50 and kick-started negotiations with European leaders over a withdrawal agreement.<\/span><\/p>\n<p>The case was brought to the ECJ by a group of Scottish politicians opposed to <a href=\"https:\/\/www.aljazeera.com\/topics\/events\/brexit.html\">Brexit<\/a>.<\/p>\n<p>Alyn Smith, one of those who initiated proceedings,\u00a0<a href=\"https:\/\/www.alynsmith.eu\/uk_can_revoke_article_50\" target=\"_blank\">described<\/a> the court&#8217;s ruling as &#8220;better than we could have hoped for&#8221;.<\/p>\n<p><span>&#8220;The timing is sublime. As colleagues in the House of Commons consider Mrs May&#8217;s disastrous deal we now have a roadmap out of this Brexit shambles,&#8221; Smith, who represents the Scottish National Party in the European Parliament, said.<\/span><\/p>\n<p>&#8220;A bright light has switched on above an &#8216;EXIT&#8217; sign,&#8221; he added.<\/p>\n<p><span>EU lawyers had argued during proceedings that revoking Article 50 required consent from the other 27 members of the EU, while the UK government said the court&#8217;s views on the matter were irrelevant as Britain would not rescind its triggering of the clause.<\/span><\/p>\n<h2><strong><span>Parliament to decide on Brexit plan\u00a0<\/span><\/strong><\/h2>\n<p>The ECJ&#8217;s decision, which the court said would &#8220;<span>clarify the options open to MPs [members of parliament]&#8221;,\u00a0<\/span>comes a day before British parliamentarians are due to vote on Prime Minister <a href=\"https:\/\/www.aljazeera.com\/topics\/people\/theresa.html\">Theresa May<\/a>&#8216;s proposed Brexit deal.<\/p>\n<p>The plan has been widely criticised across the political spectrum.<\/p>\n<p><span>Scores of May&#8217;s ruling Conservative Party MPs are expected to reject her proposal, while several opposition parties, including the main opposition Labour Party, have also said they will refuse to back it.<\/span><\/p>\n<p>Unexpected majority support would mean May can introduce a formal EU Withdrawal Agreement Bill to parliament for consideration and ratification in early 2019.<\/p>\n<p>Majority opposition, however, would force the government to put forward a new plan within 21 days.\u00a0<\/p>\n<p>That could provide May with a window of opportunity to go back to Brussels and push for revised terms of departure from the bloc.<\/p>\n<p>But even if she wins concessions from European leaders, which is not guaranteed, MPs will be able to table amendments on a fresh proposal, potentially forcing the government to alter its Brexit strategy once again.<\/p>\n<p>Alternatively, May might push for a second parliamentary vote on the same withdrawal agreement in the hope the electoral\u00a0arithmetic is changed by fears that a second rejection would risk a potentially catastrophic no-deal Brexit.<\/p>\n<p>Political events triggered by a parliamentary rejection could derail that entire process, however, and take events out of the prime minister&#8217;s hands, with a<span>\u00a0leadership challenge, general election, second referendum, substantially renegotiated deal or no-deal Brexit as the possible outcomes.<\/span><\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>The European Union&#8217;s top court has ruled that Britain may unilaterally reverse its decision to leave the bloc.\u00a0 In a judgment delivered on Monday, the European Court of Justice said the United Kingdom could revoke Article 50 &#8211; the exit clause in the EU&#8217;s constitution &#8211; &#8220;in accordance with its own national constitutional requirements&#8221;. &#8220;That&hellip;<\/p>\n","protected":false},"author":10,"featured_media":24972,"comment_status":"open","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[2],"tags":[],"class_list":["post-24971","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-middle_east_news"],"_links":{"self":[{"href":"https:\/\/qatar-news.org\/qatarnewsEn\/index.php?rest_route=\/wp\/v2\/posts\/24971","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/qatar-news.org\/qatarnewsEn\/index.php?rest_route=\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/qatar-news.org\/qatarnewsEn\/index.php?rest_route=\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/qatar-news.org\/qatarnewsEn\/index.php?rest_route=\/wp\/v2\/users\/10"}],"replies":[{"embeddable":true,"href":"https:\/\/qatar-news.org\/qatarnewsEn\/index.php?rest_route=%2Fwp%2Fv2%2Fcomments&post=24971"}],"version-history":[{"count":0,"href":"https:\/\/qatar-news.org\/qatarnewsEn\/index.php?rest_route=\/wp\/v2\/posts\/24971\/revisions"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/qatar-news.org\/qatarnewsEn\/index.php?rest_route=\/wp\/v2\/media\/24972"}],"wp:attachment":[{"href":"https:\/\/qatar-news.org\/qatarnewsEn\/index.php?rest_route=%2Fwp%2Fv2%2Fmedia&parent=24971"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/qatar-news.org\/qatarnewsEn\/index.php?rest_route=%2Fwp%2Fv2%2Fcategories&post=24971"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/qatar-news.org\/qatarnewsEn\/index.php?rest_route=%2Fwp%2Fv2%2Ftags&post=24971"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
